The comparison between fax and email for business document transmission tends to favor email on convenience and against fax on modernity. Email is faster to initiate, integrates with the tools people already use, and does not require a fax number. Those are real advantages for routine, low-stakes communication.
For critical document transmission in regulated environments, the comparison looks different. When the document is a lab result that needs to reach a physician, a prior authorization that needs to reach a payer, or a legal filing that needs to reach a court, the relevant criteria are not convenience and modernity. They are reliability, security, compliance documentation, and confirmed receipt. On each of those criteria, fax through a properly configured enterprise platform performs better than email in most real-world conditions.
Delivery Confirmation: Fax Provides It, Email Often Does Not
The most significant practical difference between fax and email for critical document transmission is what happens after the document is sent. Passport’s delivery confirmation generates a timestamped record for every fax transmission that confirms the document was delivered to the recipient’s fax number. That record is stored in the platform’s audit log and is available for compliance review, legal proceedings, or operational investigation.
Email does not reliably provide equivalent confirmation. Read receipts can be declined by the recipient’s email client. Delivery receipts confirm that an email reached a mail server, not that it was received or opened by a person. An email that is delivered to a server but filtered to spam, or delivered to a shared mailbox that nobody checks, generates a delivery receipt that is technically accurate but practically meaningless.
For organizations that need to demonstrate to a regulator, a payer, or a court that a specific document was transmitted and received on a specific date, the fax delivery confirmation is a substantially more reliable piece of evidence than an email delivery receipt.
Security: Fax Encryption Is End-to-End, Email Encryption Is Not Universal
HIPAA’s Security Rule requires that electronic PHI be encrypted in transit when transmitted over a public network. Fax transmitted through Fax 2.0 and the etherFAX network uses Transport Layer Security encryption for the full transmission path. The security of the transmission does not depend on any action or configuration at the recipient’s end.
Email encryption is more complicated. Standard SMTP email is not encrypted in a way that protects PHI in transit. Encrypting email requires either a secure email platform that applies encryption automatically, end-to-end encryption using certificates that both parties must have configured, or a portal-based approach where the recipient logs into a secure portal to retrieve the message. Each of those options requires the recipient to have compatible infrastructure or to take an additional step that a standard email workflow does not require.
For external communication with organizations whose email security posture is unknown, the uncertainty about whether encryption is applied consistently at the recipient’s end is a compliance risk that fax does not carry. The encryption is applied at the sending platform level regardless of what the recipient is running.

Spam Filtering and Deliverability: Fax Does Not Have This Problem
Email deliverability is a genuine operational challenge that is easy to overlook until it causes a problem. Spam filters, domain reputation systems, and email security gateways all make independent decisions about whether a given email should be delivered to the inbox or quarantined. A prior authorization appeal that ends up in a payer’s spam folder, or a consultation request that is blocked by a hospital’s email security gateway, has the same practical effect as a lost document even though the email was technically sent.
Fax does not have a deliverability problem in the same sense. A fax sent to a valid fax number either reaches the receiving machine or line, or it fails with a specific failure reason that surfaces in the platform’s transmission log. There is no intermediate filtering layer that silently redirects the document without the sender’s knowledge. When a fax fails, the failure is visible. When an email is quarantined by the recipient’s spam filter, the sender typically has no visibility into what happened.
For critical documents where silent non-delivery has clinical, legal, or financial consequences, that difference in failure transparency is operationally significant.
Audit Trail Completeness
Enterprise fax platforms maintain a complete and consistent audit trail for every transmission. That log is centralized, searchable, and independent of individual user email accounts.
Email audit trails are distributed across individual inboxes, sent folders, and mail server logs that may or may not be retained in a centralized, searchable format. When an organization needs to reconstruct the history of a specific document exchange for a compliance audit or a legal proceeding, retrieving that history from email may require pulling records from multiple individual accounts, mail servers, and archiving systems. The same reconstruction from a fax platform audit log is a single query.
For organizations subject to regulatory audit requirements, that difference in audit trail completeness and accessibility has practical compliance value.
